Parental Rights violations are on the rise in New Jersey

Our country is suffering from a corrupt and broken Family Court system.  The incompetence and corruption within Somerset County, New Jersey Family Court starts at the bench and carries over into  unethical case mismanagement by Family Division law clerks and staff.   Misuse of authority is built into the programs and kickbacks built into the paychecks.  Abuse of discretion is common, and generally accepted as a “normal” part of the legal process of Family Court. 

Our children deserve better.

Dishonest Judges who operate outside of their judicial role are abusing our children and destroying families, while an increasingly dysfunctional  and disinterested DYFS / CPS sits on the political sidelines.            A clear message needs to be sent to  judges, family law attorneys, and administrative staff, that the parents of the communities they serve intend to hold them accountable for misconduct, and that we expect them to be advocates, and not obstacles in Family Court reform.

  Family Court Judges step outside their role as Judge in society when they present themselves as experts in areas other than law and break judicial code.Reform is needed on so many levels, especially in the legal and psychological management of parent/child alienation cases.  Targeted parents, especially fathers, start off at a disadvantage because the Family Court is still working within the broken context of VAWAwhere false accusations of domestic violence and abuse are not easily shaken. The parent/child alienation caused by bias and poorly trained Judges approaches that of the abusive alienating parent. 

Corruption in New Jersey Courts

As Judges tolerate perjury and ignore violations of visitation orders, children are being taught to disrespect the law and authority.                                                                                     

There are no Parental Alienation laws in place in the state of New Jersey and Judges are free to ignore its existence.

Too often, Parental Rights of one parent are effectively terminated without due process, leaving the child with the abuser.

Case after case, we hear about bias Judges, corrupt Judges, clueless Judges. The future well being of our children is far too important to accept inferior child custody case management.    Until adequate training is provided to our Judges on the complex psychological dynamics of troubled families, and as  long as Judges overstep their authority, we need more eyes on the bench to ensure that they are doing the work of the Court, any nothing more. Periodic Jury panels in high conflict cases could help reduce court errors and provide for more equality based orders, resulting in less appeals, and preserving the rights of parents to determine the best interest of their children as the rule, instead of the exception. snag hot

The liberty of parents to direct the upbringing, education, and care of their children is a fundamental right.

SECTION 2

The parental right to direct education includes the right to choose public, private, religious, or home schools, and the right to make

reasonable choices within public schools for one’s child.

SECTION 3

Neither the United States nor any State shall infringe these rights without demonstrating that its governmental interest as applied

to the person is of the highest order and not otherwise served.

SECTION 4

This article shall not be construed to apply to a parental action or decision that would end life.

SECTION 5

No treaty may be adopted nor shall any source of international law be employed to supersede, modify, interpret,

or apply to the rights guaranteed by this article.

Parental Rights in New Jersey

STATE LAW

New Jersey does not have a state statute that explicitly defines and protects parental rights as fundamental rights.

IN THE COURTS

  • Moriarty v. Bradt, 827 A.2d 203, 214–15 (N.J. 2003) Summing up, when the State seeks, by statute, to interfere with family and parental autonomy, a fundamental right is at issue. That statute thus is subject to strict scrutiny and will only pass muster if it is narrowly tailored to serve a compelling state interest. (citing Washington v. Glucksberg, 521 U.S. 702, 720-21; and Roe v. Wade, 410 U.S. 113, 155-56.)

STATE RESOLUTIONS

No resolutions have been introduced in the New Jersey legislature supporting the PRA or opposing U.N. conventions that threaten parental rights.

  2. I AM A MOTHER AND WENT TO A MOTHER’S WEBSITE THAT SEEMED TO BE BASHING PARENTAL ALIENATION SYNDROME. AS I DIGGED FURTHER I FOUND OUT ABOUT DR. GARDNER WHO COINED THE TERM. ALTHOUGH I BELIEVE THAT THE SYNDROME EXISTS I DON’T THINK DR. GARDNER’S WORK WAS CREDIBLE.

    I BELIEVE PARENTAL ALIENATION EXISTS BECAUSE OF PARENTS THAT WILL DO EVERYTHING AND ANYTHING TO GAIN / MAINTAIN CUSTODY NOT TO PAY CHILD SUPPORT AND / OR TO EXTORT MONEY FROM THE OTHER PARENT IN THE FORM OF “CHILD” SUPPORT. AS A PARENT WHOSE PRIORITY IS THE CHILD, I UNDERSTAND WHY HE/SHE (MAINLY FATHERS) WOULDN’T WANT TO PAY “CHILD” SUPPORT TO THE OTHER “PARENT” UNDER THOSE CONDITIONS.

    I BELIEVE IT ALSO EXISTS BECAUSE OF “PARENTS” (HERE I HAVE TO SAY THAT IT IS ALSO MORE OFTEN “FATHERS”) WHO USE THEIR KIDS AS PAWNS AGAINST THE OTHER PARENT AND TO ABUSE THEM AS THEY DID WITH THE OTHER PARENT. THIS FIGHTING AGAINST PARENTAL ALIENATION SHOULD NOT BE ABOUT GENDER WARS (MOTHERS VS. FATHERS), BUT SHOULD BE ABOUT ENSURING THE RIGHTS / ROLES OF PARENTS AND STOPPING THE ALIENATING PARENT.

    I WANT TO BE ABLE TO POST MY COURT DOCUMENTS (WHICH ARE PUBLIC RECORDS, RIGHT?) TO PROVE MY POINTS. DOES ANYONE HAVE ANY SUGGESTIONS ABOUT HOW TO EXPOSE HOW THE “FAMILY” COURT SYSTEM IS ENABLING AND EVEN ENCOURAGING / GUIDING, ETC… THE ALIENATING PARENT?

      • LoveBlues I think you are right, but it doesn’t matter. CLEARLY THE ACT OF ALIENATING A PARENT DEFINITELY EXISTS. The whole debate around a actual psychological disorder is a stupid sideshow created by Family Court insiders and snake-oil “expert witnesses”.

        What we suggest to parents is avoid including the word “syndrome” when discussing parental alienation because it has become such a charged word in court and among psychologists…. discussing it becomes and expensive sidegame of expert witnesses, and it proves nothing.

        Focus on the act of parental alienation and the best interests of the children and the studies related to parent child relationships etc.

        The whole debate around the “syndrome” is incredibly stupid and it flies in the face of common sense related to breaking parent-child bonds.
